Q：建築パースの著作権について
今年に入ってから個人事業で建築パースの制作の事業を始めました。パースの著作権について質問させていただきます。
現在、営業先をまわる時に業務の流れと業務FEEを記載したリーフレットを作成し、配っております。その中に「業務よって生じた成果品の著作者人格権及び著作権は当社に帰属します。」という一文を記入しております。通常、著作権については特にとやかく言われたりする事は無いのですが、先日ある事務所に営業をした際に建築パースの「著作権は買い取りにしている。」と言われました。しかし、詳しく聞いてみると、買い取りのための料金等は別途支払わず制作時の料金のみで買い取りとしているとのこと。先方曰く、「写真の買い取りと同じだ。」というのです。私は写真（またはイラストも）の買い取りに関して詳しくないのですが、それらの場合は著作権は通常買い取りとなっているのでしょうか。また、もし買い取りとなる場合は別途に料金を請求するものなのでしょうか。その会社とは仕事をしてみたいと思っておりましたので、どうしたものか迷っております。また、建築パースの制作に関する著作権について発生する料金等について通常どのようなものがあるのか教えていただけますでしょうか。

A：著作権と所有権を混同されている方が沢山います

私たちクリエイティブに携わる人間も、まだまだ著作権と所有権を混同されている方が沢山います。
例えばバービー人形やリカちゃん人形などを購入し、写真に撮った物を広告に使えるのか？「人形を定められた金額で購入したのだから人形の著作権も含まれている。」と考えがちですが、これはお金を支払って所有権を購入したもので、これを写真に撮り広告に使ったりすると「マテル社」や「タカラ」から著作権侵害で訴訟を起こされます。
同じようにレゴブロックなど、形のない素材に関しても同じで、ブロックで建物を造りパースの代わりにレゴの建物を入れると「レゴブロック社」から訴えられます。
イラストや写真、ご質問のパースに関しても同じで、著作権は譲渡出来ません。
譲渡出来るのは所有権・複製権・公衆送信権等・展示権・頒布権・譲渡権・貸与権・翻訳権と、8つの権利でしょう。
所有権は文字の通り所有する権利、複製権は写真やスキャナーで読み込んだデーターなどを利用し、印画紙や印刷などで複製する権利、公衆送信権は、テレビ放送など（最近はWebも含まれると考えても良いでしょう）で放送される権利、展示権・頒布権・譲渡権・貸与権は読んだ字のままです。
翻訳権は納品した事務所側での、修正やトリミングなどの権利です。
ただ、パースの解釈が難しい点は、デザインが例えば設計事務所で考えられ、仕上げの素材の選択や色も建築士が行うケースがほとんどでしょう。
この事からパースも設計事務所でデザインされた著作物の翻訳権を使って形を変えたもう一つの物、と解釈されている可能性もあります。
ただし著作物の翻訳であったにしても、パースのタッチなど、独自性があるでしょうかられっきとした著作物であることには変わりありません。
アフロさんが今まで仕事をされてきて、書き上げたパースをこのような形で使って貰いたくはなかった、使う前に一言了解を取って欲しかった、と言うことはありますか。
もしあるのでしたら、その部分を上記にある8つの譲渡出来る権利を参照する形で、契約を結ばれるのがよいでしょう。
料金についてはB-3ならいくら、A-1ならいくらと、ほとんどパースの大きさでだいたい決まっているのではないのでしょうか、譲渡する権利の数で金額は変わってこないと思います。
